Part 1: Terms of Use for Websites and Nando's App

Welcome to Nando’s website and/or mobile app. This page tells you the terms of use (the "Terms") on which you may make use of our websites or any mobile app we make available via an app store, whether as a guest or a registered user. Please read these Terms carefully before you start to use our Websites or Nando's App (as defined below). 

When certain words and phrases are used in these Terms, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Terms where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

In these Terms, when we refer to "we", "us" or "our", we mean the Company; and when we refer to "you" or "your" we mean you, the person accessing or using the Websites or Nando's App.

1. Information about us

1.1 Nando’s Chickenland Limited is a company registered in England and Wales under company number 02580031, with its registered office at St Marys House, 42 Vicarage Crescent, London, SW11 3LD, operating from Erico House, 93-99 Upper Richmond Road, London SW15 2TG and with VAT number GB 662 8275 13 (the "Company"). 

1.2 The Company operates the following websites in the UK: 

   • nandos.co.uk (the "Nando's Website"), and

   •  shop.nandos.co.uk

each a "Website" and together the "Websites".

1.3 The Company also operates the Nando's mobile app (the "Nando's App"). 

2. Websites and Nando's App

2.1 The Websites and Nando's App are made available free of charge. We do not guarantee that the Websites and Nando's App, or any content on them, will always be available or be uninterrupted. Access to the Websites and Nando's App is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Websites or Nando's App without notice. We will not be liable to you if for any reason the Websites or Nando's App are unavailable at any time or for any period. We may update the Websites and Nando's App and/or change the content on them at any time. 

2.2 You are responsible for making all arrangements necessary for you to have access to the Websites and Nando's App. You are also responsible for ensuring that all persons who access the Websites and Nando's App through your internet connection are aware of these Terms and that they comply with them.

2.3 The Nando's App requires a smartphone or other mobile device running either the iOS or Android operating systems (the device you use, the "Device") and, to download the Nando's App and to access the latest features, you will need Internet access.

2.4 Please note that certain functions made available on the Websites and Nando's App are governed by additional terms and conditions set out at Part 1a below. In order to download the Nando's App you must also review and agree to the additional Nando's App terms set out below and any other terms and conditions imposed by the app store from which you have downloaded the Nando's App.  

2.5 The Websites and Nando's App and the content on it are provided for general information purposes only. They are not intended to amount to advice (medical or otherwise) on which you should rely.

2.6 You may only use the Websites and Nando's App for your own domestic, private and non-commercial use.

3. Your account and password

3.1 You will need to register an account with us in order to access certain services available on the Websites and Nando's App ("Account"). If you register an Account, you will be asked to provide certain information (such as your email address) and to create a password, as part of our security procedures.  If you register an Account you will become a "Registered User".

3.2 We use Single Sign On ("SSO") for account management. This means that Registered Users can access all of our online services with one set of log in details. 

3.3 You must be at least 14 years old to register an account, however if you are under the age of 18 years old you must ask for permission from your parent or legal guardian prior to registering an account. There are also certain additional age restrictions for use of certain services listed below:

    3.3.1 You must be 18 or over to order online for delivery or collection (see our Online Ordering Terms & Conditions below) or to purchase personalised bottles (see part 7 of our Terms & Conditions);

    3.3.2 You must be 18 or over to register a Gift Card (see our Gift Card Terms & Conditions below); and

    3.3.3 You must be 16 or over to opt in to receive marketing communications.

3.4 To protect your Account, keep your password confidential and do not disclose it to any third party. You are responsible for the activity that happens on or through your Account. It is best practice not to reuse your Account password on third-party applications. If you know or suspect that anyone other than you know your Account login details, you must immediately notify us via our contact us form: https://help.nandos.co.uk/hc/en-gb/requests/new?ticket_form_id=12958532951313.

3.5 Our setting for SSO timeout is 14 days. This is set to protect your data should a hacker attempt to compromise it, therefore minimising that window.

3.6 We have the right to disable any Accounts and/or passwords, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

4. General Acceptance Use

4.1 You agree not to:

    4.1.1 use the Websites or Nando's App in any way that breaches these Terms or any applicable local, national or international law or regulation;

    4.1.2 copy, or otherwise reproduce or re-sell any part of the Websites or Nando's App unless expressly permitted to do so in these Terms; or

    4.1.3 do any act or thing that might damage, disrupt or otherwise interfere with the operation of the Websites or Nando's App or any equipment, network or software used in operating the Websites or Nando's App.

5. User Generated Content

5.1 If it is the case that you supply/upload any content to the Websites or Nando's App – whether it be pictures, text, sound recordings or whatever – the content you supply ("User Generated Content") must comply with the following rules:

    5.1.1 it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone;

    5.1.2 it must not harass or bully another person;

    5.1.3 it must be true and honest so far as you know;

    5.1.4 it must not be defamatory of anyone;

    5.1.5 it must not use the material or content or infringe the rights or privacy of anyone else; for example, you should not use images of well-known characters, footage or music (unless it is your own);

    5.1.6 it must not contain someone else’s personal details or confidential information relating to other people; and

    5.1.7 it must not promote or condone terrorism, violence or illegal behaviour.

5.2 We reserve the right to refuse to accept or refuse or cease to use any User Generated Content supplied by any person that we think contravenes these rules.

5.3 In addition, we may from time to time provide interactive services on the Websites or Nando's App that shall enable you to upload User Generated Content, including, without limitation: 

    5.3.1 comment facilities;

    5.3.2 chat rooms; and/or

    5.3.3 bulletin boards, (together "Interactive Services").

5.4 Where we provide an Interactive Service, we will use reasonable endeavours to provide information to you about the kind of service offered and if it is moderated. However, we are under no obligation to oversee, monitor or moderate any Interactive Service we provide.

5.5 The use of any of our Interactive Services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online. Minors who are using any Interactive Service should be made aware of the potential risks to them.

6. Viruses

6.1 We do not guarantee that the Websites or Nando's App will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the Websites or Nando's App and we recommend that you use your own virus protection software.

6.2 You must not misuse the Websites or Nando's App by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Websites or Nando's App, the server on which the Websites or Nando's App are stored, or any server, computer or database connected to the Websites or Nando's App. You must not attack the Websites or Nando's App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Websites or Nando's App will cease immediately.

7. Intellectual property

7.1 We are the owner or licensee of all intellectual property rights in the Websites and their content, the Nando's App and its content, the Nando's name and mark and Nando's product names, images and packaging. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.

7.2 You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Terms. You must not use the Websites or Nando's App (or any part of them or their content) for commercial purposes; however, you may download material from the Websites and Nando's App solely for non-commercial, personal use by you.

7.3 No part of the Websites or Nando's App, including, without limitation, the text, designs, graphics, photographs and images contained in them, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.

7.4 Any communications or materials you send to us through the Websites or Nando's App by electronic mail or other means will be treated as non-proprietary and non-confidential (other than communications in respect of your order if you use the Websites or Nando's App to buy products from us). We are free to publish, display, post, distribute and otherwise use any ideas, suggestions, concepts, designs, know-how and other information contained in such communications or material for any purpose, including, but not limited to, developing, manufacturing, advertising and marketing us and our products. You grant us a non-exclusive, transferable, perpetual, royalty-free, worldwide licence to copy, use, reproduce, distribute, display, publish, adapt, prepare derivate works of and/or amend any User Generated Content in any format, including in our services and products for any purpose including in relation to the promotion of our services and products. 

7.5 We grant to you a non-transferable, non-exclusive, revocable licence to use the Nando's App on the Devices provided that you comply with these Terms and the documents referred to in it.  We reserve all other rights.

8. Our liability

8.1 Nothing in these Terms excludes or limits our liability for:

    8.1.1 death or personal injury caused by our negligence;

    8.1.2 fraud or fraudulent misrepresentation; and

    8.1.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

8.2 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the Website and/or Nando's App.

8.3 We only supply the Websites and Nando's App for domestic and private use. You agree not to use the Websites or Nando's App, or any content on the Websites or Nando's App, for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

8.4 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

8.5 We assume no responsibility for the content of websites linked to from the Websites or Nando's App or included in these Terms (including links to any commercial sponsors or partners). Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. 

9. Suspension and termination 

9.1 If you breach any of these Terms, we may immediately do any or all of the following (without limitation):

    9.1.1 issue a warning to you;

    9.1.2 temporarily or permanently remove any User Generated Content uploaded by you to the Websites or Nando's App;

    9.1.3 temporarily or permanently withdraw your right to use the Websites and/or Nando's App;

    9.1.4 suspend or terminate your Account;

    9.1.5 issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

    9.1.6 take further legal action against you; and/or

    9.1.7 disclose such information to law enforcement authorities as we reasonably feel is necessary to do so.

10. Changes to these Terms 

10.1 We may make changes to these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you access and use the Websites or Nando's App. If you are a Registered User, we will provide you with at least thirty days advance notice of any such changes, unless such changes are required on shorter notice to comply with applicable law. If you do not wish to continue using the Websites and/or the Nando's App following the changes to the Terms, you can cancel your agreement to these Terms by cancelling your Account.

11. Other important information 

11.1 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.

11.2 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

12. Governing law and jurisdiction

12.1 These Terms are governed by the laws of England and Wales.  This means that your access to and use of the Websites and Nando's App, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law.  However, as a consumer, if you are resident in the European Union and we direct the Website or Nando's App to the member state in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident.  Nothing in these Terms, including this clause 12.1, affects your rights as a consumer to rely on such mandatory provisions of local law.

12.2 If you are a consumer, you may bring any dispute which may arise under these Terms to - at your discretion - either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is an EU Member State. We shall bring any dispute which may arise under these Terms to the competent court of your country of habitual residence if this is in an EU Member State, or otherwise the competent court of England.

Part 1a: Additional Nando's App Terms

1.1 The following terms and conditions shall apply to your use of the Nando's App in addition to those set out in Part 1.  

1.2 For the purpose of these terms, "Appstore Provider" means the provider of the app store through which you have downloaded the Nando's App (for example, Apple is the Appstore Provider if you have downloaded the Nando's App from the Apple App Store, Google is the Appstore Provider if you have downloaded the Nando's App from Google Play, etc).

1.3 You acknowledge and agree that the Terms have been concluded between you and us, and not with the Appstore Provider.  You acknowledge and agree that the Appstore Provider is not responsible for the Nando's App and its content.

1.4 You acknowledge and agree that the Appstore Provider has no obligation to provide any maintenance or support in respect of the Nando's App.  Should you have any problems in using the Nando's App, please contact us via our contact us form: https://help.nandos.co.uk/hc/en-gb/requests/new?ticket_form_id=12958532951313 or call 020 3974 2182.

1.5 In the event that the Nando's App does not conform with any product warranty provided for by the Terms, the Appstore Provider may provide you with a refund of the price that you paid to purchase the Nando's App (if any).  The Appstore Provider shall, to the maximum extent permitted by law, have no obligation to you whatsoever with respect to the Nando's App.

1.6 You acknowledge and agree that the Appstore Provider shall not be responsible for addressing any claims that you might have relating to the Nando's App, including (without limitation): product liability claims; any claim that the Nando's App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection or similar legislation. 

1.7 In the event that a third party claims that the Nando's App infringes its intellectual property rights, we (and not the Appstore Provider) shall be solely responsible for the investigation, defence, settlement and discharge of such claim.

1.8 You warrant and represent that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

1.9 If the Appstore Provider is Apple, you acknowledge and agree that Apple and its subsidiaries are third party beneficiaries to the Terms. Upon your acceptance of the Terms, Apple will have the right to enforce the Terms against you as a third party beneficiary.

Part 2: Online Ordering Terms and Conditions

This page tells you the terms of use (the "Terms") on which you may order the products (each an "Order") available on the Order Website ("Products").

When certain words and phrases are used in these Terms, they have specific meanings (these are known as "defined terms"). In these Terms, when we refer to "we", "us" or "our", we mean the Company; and when we refer to "you" or "your" we mean you, the person accessing or using the Websites or Nando's App.

1. Information about us

1.3 The Company also operates the Nando's App (the "Nando's App"). 

2. Ordering Products

2.1 You may order Products online directly from us via the Order Website if you wish to collect your Products in-restaurant (“Collection Orders”) or for home delivery by us (“Delivery Orders”) depending on which restaurant you choose.

2.2 You may also order Products by phone for collection in-restaurant. In this case, please call the relevant restaurant telephone number available on the Nando’s Website and follow the instructions of the operator. You will be required to pay for such order when you collect your Products from the relevant restaurant. 

2.3 You must be at least 18 years old to place an order online or via the telephone.

2.4 In order to place an Order for delivery on the Order Website or Nando's App, you will need to log-in using your Google or Facebook social media account ("Account"). This is the only way to place an Order for delivery on the Order Website or Nando's App at this time. If you don't have a Google or Facebook account, you can still place an Order for collection on the Order Website or Nando's App or by phone (further details are available in clauses 2.1 and 2.2 above). Nando's delivery service is brought to you by deliveroo, meaning that Deliveroo provides us with technical assistance in relation to the Order Website and Nando's App and the delivery services. We act as agent in relation to the delivery services provided by Deliveroo. In order for your Order to be delivered to you, a Deliveroo account will need to be created for you (if you don’t have one already associated with your Google or Facebook social sign-on). You will have been presented with a link to the T&Cs applicable to your Deliveroo account, and a link to Deliveroo's Privacy Notice, on the log-in page of the Order Website or Nando's App. For further details please see the terms on Deliveroo's website - https://deliveroo.co.uk/legal and https://deliveroo.co.uk/privacy

2.5 To submit a Collection Order or a Delivery Order via the Order Website or Nando's App you must first sign-in to your Account and then follow the procedure set out on the Order Website or Nando's App to submit your Order. You should check all the information that you enter and correct any errors before submitting your Order, as once your Order is submitted, we will begin processing it immediately and you may not be able to correct any errors.

2.6 Your Order constitutes an offer to us. We will confirm our acceptance of your Order by sending you an email confirming the information you included in your Order (the "Confirmation Email"). These Terms and the Order will become legally binding on you and us when we send you the Confirmation Email and each Order shall incorporate these Terms and shall be a new and separate contract between you and us. The contract shall be in the English language. We will not file a copy of the contract. 

3. Collection 

3.1 Your collection time will be set out during the Order process.

3.2 If you do not collect your Order within thirty (30) minutes of your collection time, your Products will be disposed of and you will not receive a refund.

4. Delivery

4.1 When you submit a Delivery Order, we act as an agent on behalf of Deliveroo in respect of the delivery services Deliveroo provide in delivering the Products to you.

4.2 Please note that all delivery times are estimates and the actual delivery time may vary from this estimate. You should also be aware that if you request and we agree to change your delivery address following submission of an Order this may lead to a significant delay in your delivery time.

4.3 If, during delivery of an Order, you or your authorised representative as specified in your Order (as appropriate) fail to take delivery of the Products within five (5) minutes of our delivery driver's arrival (other than due to our material breach of these Terms):

    4.3.1 the delivery shall be aborted; and

    4.3.2 you will not receive a refund for your Order.

4.4 You shall be responsible for:

    4.4.1 ensuring that the delivery driver has such access and parking facilities as may be reasonably required to carry out the Order;

    4.4.2 ensuring that either you or your authorised representative (as specified in the Order) are present to take delivery of the Products at the delivery place specified in your Order; and 

    4.4.3 providing us with your up-to-date contact details in your Account and/or Order.

5. Payment

5.1 The prices for the Products and (if applicable) for delivery and service are set out on the Order Website and Nando's App and are inclusive of VAT. Please note that if your Delivery Order is below a minimum value then an additional charge, as set out on the Order Website or Nando's App during the ordering process, may also apply.

5.2 In relation to Delivery Orders, delivery and service charges are set by Deliveroo but are paid directly to us acting as agent on behalf of Deliveroo.

5.3 It is always possible that, despite our best efforts, some of the Products may be incorrectly priced. We will normally check prices before accepting your Order so that, where a Product's correct price at the time of your Order is less than our stated price at that time, we will charge the lower amount. If the Product's correct price at the time of your Order is higher than the price stated to you, we will contact you for your instructions before we accept your Order. If we accept and process your Order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.

5.4 If your payment is not authorised, your Order will not be sent through to the restaurant or fulfilled.

6. Cancellation and refunds

6.1 Please note that you do not have a right to cancel any contract for Products under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulation 2013.

6.2 You may request that your Order is cancelled or changed after it has been submitted, but this will only be possible before the applicable restaurant has received the Order. This can be done by contacting the Customer Experience Team (see below for details). No refund will be permissible if the attempt to cancel is made after the restaurant has received the Order.

6.3 If you cancel or change your Order, your original payment will still be processed. Where you are eligible for a refund, you can obtain this by contacting our Customer Experience Team (see below for details). We will process refunds within ten (10) working days.

7. Other refunds

7.1 You have legal rights in relation to Products that are not as described, faulty or otherwise not fit for purpose. If you believe that any Products that you have ordered do not conform with these Terms, please contact our Customer Experience Team to discuss a replacement or refund.

7.2 If, due to unforeseen circumstances, we are unable to fulfil your Order or any of the Products in a particular Order, we will refund the value of the Product(s) that we were unable to fulfil and, if the full Order is cancelled, any delivery and service charges. You may obtain a refund by contacting our Customer Experience Team (see below for details).  

8. Products

8.1 We endeavour to provide information on any allergens that the Products may contain on the Nando’s Website, but please note that:

    8.1.1 because all Products are cooked to order in the same kitchen we cannot guarantee and make no warranty that the Products will not contain any allergens;

    8.1.2 the kitchen is a busy working environment and there is a risk of cross-contact between ingredients;

    8.1.3 For Click & Collect and Delivery Orders, we can't currently cater for specific dietary requirements, sorry! If you visit the menu page you can see all our allergen information; and   

    8.1.4 please consult our menu terms and conditions (Part 3 below) for further information regarding allergens in the Products.

8.2 Our Products are freshly prepared and although we try our best to be consistent at times the size of the portions can vary.

9. Our liability

9.1 Nothing in these Terms excludes or limits our liability for:

    9.1.1 death or personal injury caused by our negligence;

    9.1.2 fraud or fraudulent misrepresentation; and

    9.1.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

9.2 Subject to clauses 9.1 and 9.3 our maximum liability to you, in respect of any particular Order, will be limited to the value of that Order (which includes any delivery and service charges) as set out in the relevant Confirmation Email.

9.3 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time of the conclusion of the contract for Products.

9.4 We only supply the Products for domestic and private use. You agree not to use the Products for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9.5 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

10. Suspension and termination 

10.1 If you breach any of these Terms, we may immediately do any or all of the following (without limitation):

    10.1.1 issue a warning to you;

    10.1.2 temporarily or permanently withdraw your right to use the Websites and/or Nando's App;

    10.1.3 suspend or terminate your Account;

    10.1.4 issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

    10.1.5 take further legal action against you; and/or

    10.1.6 disclose such information to law enforcement authorities as we reasonably feel is necessary to do so.

11. Changes to these Terms 

11.1 We may make changes to these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms) but the Terms applicable at the time of your Order will apply to that Order. Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you order the Products.

12. Other important information 

12.1 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.

12.2 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

13. Governing law and jurisdiction

13.1 These Terms are governed by the laws of England and Wales.  This means that your purchasing of Products and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law.  However, as a consumer, if you are resident in the European Union and we direct the Websites or Nando's App to the member state in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms, including this clause 13.1, affects your rights as a consumer to rely on such mandatory provisions of local law

13.2 If you are a consumer, you may bring any dispute which may arise under these Terms to - at your discretion - either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is an EU Member State. We shall bring any dispute which may arise under these Terms to the competent court of your country of habitual residence if this is in an EU Member State, or otherwise the competent court of England.

This link is provided as required by Regulation (EU) No 524/2013 of the European Parliament and of the Council, for information purposes only.  We are not obliged to participate in online dispute resolution.

General 

1.1 We serve most of the allergens listed in clause 1.8 in at least one product on our menu, so there may be a risk of cross contact.    

1.2 If you have special dietary requirements you must state your requirements at the time you place an order to allow our staff to take all reasonable precautions to avoid cross contact.

1.3 The allergy information is accurate on the day it is consulted online but may change at any future time.  If you have any special dietary requirements or allergies you must check the Food Allergy & Nutritional Information book (available in all Nando’s restaurants from the manager) each time you visit Nando’s or place an order online before placing your order, just in case any of our ingredients have changed.

1.4 The information concerns only intended ingredients of menu items and does not include any customisation to a menu item (e.g. adding cheese to a burger).  Any customisation must be checked in the Food Allergy & Nutritional Information book before placing any orders.

1.5 Each menu item has a list of ingredients.  This is the fullest information we have from our suppliers and is consistent with UK labelling laws.  Please be aware that certain ingredients, especially those with small quantities in the recipe, do not have to be fully broken down (e.g. “spices”).

1.6 Please note that Nando’s are not vegetarian restaurants, however we do take specific steps to segregate our non-meat products from our meat products as follows:

    1.6.1 a segregated area of the grill is defined for the exclusive cooking of non-meat products;

    1.6.2 separate utensils are always used with non-meat products; and

    1.6.3 separate bottles of the Nando’s bastes are used exclusively for basting the non-meat products. 

1.7 The manager on duty will be best placed to answer any questions about our kitchen practices to allow customers with special dietary requirements to make an informed choice about eating in the restaurant or ordering products online.

Part 4: Gift Card Terms & Conditions

These terms and conditions (the "Terms") govern your use of the Nando's Gift Card. 

When certain words and phrases are used in these Terms, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Terms where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

In these Terms, when we refer to "we", "us" or "our", we mean the Company; and when we refer to "you" or "your" we mean you, the person using the Nando's Gift Card.

1. Information about us

1.3 The Company also operates the Nando's App (the "Nando's App").

2. Obtaining your Nando's Gift Card

2.1 The Nando's Gift Card is issued and operated by the Company.

2.2 The Nando's Gift Card allows you to upload a cash value (in British Pound Sterling) onto your Nando's Gift Card which can be used to pay for Nando's products and services. The money loaded onto your Nando's Gift Card is only a pre-payment system for the goods and services of participating Nando's restaurants in the UK; it is not a credit card, credit line or deposit account. No interest, dividends or any other earnings will accrue on the money loaded onto your Nando's Gift Card.

2.3  To upload money onto a Nando's Gift Card, you must be aged 18 or over and a resident in the UK. The Nando’s Gift Card can be used by UK residents aged 14 or over.

3. Uploading money on to and using a Nando's Gift Card 

3.1 The card can be loaded with any value between £5 and £100.  The maximum value which may be stored on the card is £100.

3.2 The monetary value on your Nando's Gift Card can be used as full or part payment for Nando's products and services at any participating Nando's restaurant in England, Scotland, Wales and Northern Ireland. For the avoidance of doubt, your Nando's Gift Card cannot be used in the Republic of Ireland. When you use your Nando's Gift Card, the cash balance on your Nando's Gift Card will be reduced by the full cash value of your Nando's purchase. We reserve the right to correct or amend the remaining balance in your account if we believe that an invoicing or accounting error has occurred. If you wish to contest such a correction or amendment to your account balance, please contact our Customer Service Team (see details below).

3.3 You must be present with your Nando's Gift Card when you make purchases in a Nando's restaurant. You should treat your Nando's Gift Card as cash for any purchases in participating Nando's restaurants in the UK.

3.4 The money uploaded to your Nando's Gift Card cannot be exchanged for cash or refunded to your credit card or debit card. Any remaining balance will be stored on your Nando's Gift Card and may be used to pay, in whole or in part, for future purchases at Nando's restaurants.

3.5 All money uploaded on your Nando's Gift Card must be used by the expiry date which is 18 months from the date that the money was uploaded on to the Nando's Gift Card. Any balance left on the Nando's Gift Card after this date will be forfeited and cannot be refunded.

4. Lost or stolen Nando's Gift Cards

4.1 You are responsible for any unauthorised payments using your Nando's Gift Card. Therefore please do not allow others to use your Gift Card. Nando's is not liable for lost, stolen or damaged Gift Cards. However if you register your Gift Card with us, we will replace any lost, stolen or damaged Gift Cards with a new Gift Card with the balance remaining on it at the time you notified us of your lost/damaged/stolen card. You can register your Gift Card at https://www.nandos.co.uk/eat/gift-card.

5. Limitations of use of your Nando's Gift Card

5.1 Please note that the Nando's Gift Card cannot be used to purchase products on the Websites or Nando's App.

5.2 Nando's Gift Cards may not be sold, exchanged or used for any other purpose, except as specified in these Terms, without Nando's written permission.

5.3 We do not warrant or represent that your Nando's Gift Card will always be accepted at participating Nando's restaurants. For example, in the unlikely event of a failure of our IT and communications systems, we may not be able to accept Nando's Gift Cards as payment during such a system failure.

5.4 We reserve the right to refuse to accept a Nando's Gift Card or to limit the use of a Nando's Gift Card if we deem it to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected by fraud, misconduct or unauthorised use. We may withdraw or cancel your Nando's Gift Card or take any other action we may deem appropriate if we suspect fraud, misconduct or unauthorised use of your Nando's Gift Card. The Nando's Gift Card shall become invalid once cancelled and you will not be able to redeem the balance on your Nando's Gift Card.

5.5 We reserve the right to withdraw the Gift Card scheme on reasonable notice, such changes will be posted on https://www.nandos.co.uk/eat/gift-card. If you have registered your Nando's Gift Card, then we will notify you of any withdrawal by email. In such event any amount remaining on you card will be reimbursed to you via a bank transfer.

6. Our liability

6.1 Nothing in these Terms excludes or limits our liability for:

    6.1.1 death or personal injury caused by our negligence;

    6.1.2 fraud or fraudulent misrepresentation; and

    6.1.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

6.2 Subject to clauses 6.1 and 6.3, our maximum liability to you in relation to your use of any Gift Card shall under no circumstances exceed the outstanding balance held on your Gift Card.  

6.3 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you used your Nando's Gift Card.

6.4 We only supply the Nando's Gift Card for domestic and private use. You agree not to use the Nando's Gift Card for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

6.5 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

7. Suspension and termination 

7.1 If you breach any of these Terms, we may immediately do any or all of the following (without limitation):

    7.1.1 issue a warning to you;

    7.1.2 temporarily or permanently withdraw your right to use your Nando's Gift Card;

    7.1.3 issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

    7.1.4 take further legal action against you; and/or

    7.1.5 disclose such information to law enforcement authorities as we reasonably feel is necessary to do so.

8. Changes to these Terms 

8.1 We may make changes to these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you use the Nando's Gift Card. If you have registered your Nando's Gift Card, we will provide you with at least thirty days' advance notice of any changes to the Terms, unless such changes are required on shorter notice to comply with applicable law. 

8.2 If you do not agree with any amended Terms in respect of your Nando's Gift Card, you can cancel your Nando's Gift Card and any amount remaining on you card will be reimbursed to you.

Part 5: Nando’s Reward Card Terms & Conditions

These terms and conditions are all about Nando's Rewards.
Certain words and phrases have specific meanings – also known as "defined terms". They'll always start with a capital letter – even if they’re not at the start of a sentence. If you’re looking for the meaning of a defined term, the explanation will be in a bracket with quotation marks.

Whenever we use "we", "us" or "our", we mean the Company. When we use "you" or "your," we’re talking to you, the person using Nando's Rewards.

2. Joining Nando’s Rewards

2.1 You can join Nando’s Rewards for free by signing up at https://www.nandos.co.uk/card/about. Then add your Nando’s Card to your mobile wallet (Apple Wallet or Google Wallet). You can also get a physical Nando’s Card at any participating Nando’s restaurant - as long as they have some available.

2.2 Your Nando’s Card is issued by us so will always belong to us too. Use it according to these terms and at participating Nando's restaurants.

2.3 It's not a credit card, charge card or debit card and can’t be used to buy anything from us.

2.4 To register, earn Chillies and redeem Rewards you must be 14+ and live in the UK . We might need to see proof of age beforehand and reserve the right to verify your age.

3. Registering your Nando's Card

3.1 If you join Nando’s Rewards online, your card will be automatically registered.

3.2 If you have a physical Nando's Card, you’ll need to register it online at https://www.nandos.co.uk/card/account or on the Nando's app. You’ll need a valid email address and give us some other contact details. Only one Nando's Card can be registered per email address.

3.3 Chillies can be earned without registering your Nando’s Card, but Rewards can only be redeemed if it’s registered.

3.4 After joining online or registering your physical Nando's Card you will automatically earn one bonus Chilli.

4. How to earn Chillies and Rewards

4.1 Earn one Chilli per day when you spend £7 or more after any discounts are applied

4.2 As your Chillies add up, you’ll earn Rewards. Rewards are earned when you’ve collected 3, 6 and 10 Chillies. Once you reach 10 Chillies and you earn a Red Reward, your reward is banked, your balance then resets to 1 and you'll start earning towards 10 Chillies again.

4.3 Chillies can be earned at participating Nando’s restaurants, with online orders at nandos.co.uk or on the Nando’s app.

4.4 If you’re at the till, you’ll need to show a valid physical Nando's Card or your Mobile Wallet to earn a Chilli. If you're ordering online or using Order at Table, make sure you've logged into your Nando’s Rewards account to earn a Chilli.

4.5 If you use Guest Checkout when using Order at Table, you won't be able to earn a Chilli.

4.6 Forgot to use your card? You have 180 days after the order was made to claim the Chilli back.

4.7 You can't currently earn Chillies at any outdoor catering events or on orders placed on the Deliveroo website or app.

4.8 Non-food items like Gift Cards, bag charges, delivery fees and small order fees don’t count towards the minimum spend. If you’re not sure, just ask a member of staff.

4.9 Chillies are personal to the Nando’s Card holder and can't be grouped with another account holder or transferred to someone else or their card.

4.10 If you have multiple Nando's Cards, it's not possible to merge Chillies and rewards onto a single account.

5. Checking your Nando’s Rewards balance

5.1 If your Nando's Card’s been registered, you can check your account balance at https://www.nandos.co.uk/card/account or at participating Nando's restaurants and on the Nando's app.

5.2 If you check your balance online, you’re responsible for potential connection charges and we’re not liable for any communication failure.

5.3 We reserve the right to correct or amend the balance in your account if we think there's been an error. If this has happened and you’d like to dispute, it just get in touch. 

6. Redeeming Rewards

6.1 Rewards can be redeemed from the day you’ve earned one and are valid for up to 366 days.  

6.2 Any Rewards that haven’t been redeemed by the expiry date will be forfeited and removed from your account.

6.3 Reward options are:

    6.3.1  3 Chillies = Green Reward. A green Reward is valid for a free 1/4 Chicken, 3 Chicken Wings or any Starter (excluding Dare to Share).

    6.3.2  6 Chillies = Orange Reward. An Orange Reward is valid for a free 1/2 Chicken or any single Burger/Pitta/Wrap (excluding Butterfly Burger, Sunset Burger and Garlic Churrasco Burger).

    6.3.3  10 Chillies = Red Reward. A Red Reward is valid for a free Whole Chicken, any single Burger/Pitta/Wrap with 1 or 2 regular sides only, a PERi-PERi Chicken meal with 1 or 2 regular sides only or a Salad or bowl with a protein (excluding PERi-Mac & Cheese, Leafy Green Salad, 10 Chicken Wings, Wing Roulette, Butterfly Burger, Nandinos Meals, Sharing Platters and Fully Loaded Chips).

    6.3.4  When redeeming a Reward, any additional ingredients in Burgers, Pittas and Wraps or Extras won’t be included and you’ll need to pay the difference.

    6.3.5  Trial products and selected seasonal and limited time products can’t be redeemed with Nando’s Rewards.

6.4 Rewards can be redeemed at any participating Nando’s restaurant, online at nandos.co.uk as well as the Nando’s app.

6.4.1 If you’re at the till, you’ll need to show a valid physical Nando's Card or your Mobile Wallet to earn or redeem a reward. If you're ordering online or using Order at Table, make sure you've logged into your Nando’s Rewards account to earn or redeem a reward.

6.4.2 If you use Guest Checkout when using Order at Table, you won't be able to earn or redeem rewards.

6.5 Redeeming a Reward doesn't affect your Chilli balance or progress to your next reward. Once you reach 10 Chillies and earn a Red Reward, your reward is banked, your Chilli balance resets to 1 and you’ll start earning all over again.

6.6 There's no cash alternative to rewards available.

7. Lost or stolen physical Nando's Cards

7.1 We are not liable for lost, stolen or damaged Nando’s Cards. However, if you register your physical Nando’s Card with us, we will (at our sole discretion) replace any lost, stolen or damaged Nando’s Cards with a new Nando’s Card and include the balance remaining from the original Nando's Card at the time that the new Nando's Card is issued to you.

7.2 To report your physical Nando’s Card lost, stolen or damaged head to www.nandos.co.uk/card, login and click on the 'Request Card' link.  Your replacement Nando’s Card will be delivered to your registered address. 

8. Limitations of use of Your Nando's Rewards

8.1 Nando's Cards should not be sold, exchanged or used for any other purpose than specified in these Terms, without our written consent.

8.2 We don’t warrant or represent that Nando’s Rewards will always be accepted at participating Nando's restaurants. For example, in the unlikely event of a failure of our IT and communications systems, we may not be able to add Chillies or allow you to redeem a reward during such a system failure.

8.3 We reserve the right to refuse to accept a Nando’s Card or to limit the use of Nando’s Rewards if we think it’s been tampered with, duplicated, damaged or suspected to be affected by fraud, misconduct or unauthorised use. 9.1 We reserve the right to withdraw the Nando’s Rewards programme on reasonable notice. Any such changes will be posted on https://www.nandos.co.uk/card/about - make sure you check this page regularly. If you’ve registered your Nando's Card, we’ll always notify you of any withdrawal.

9.2 You have the right to cancel your Nando’s Rewards account at any time, but you’ll lose the right to redeem all unused rewards. Get in touch to cancel your Nando’s Rewards account.

10. Our liability

10.1 Nothing in these Terms excludes or limits our liability for:

14. Governing law and jurisdiction

14.1 These Terms are governed by the laws of England and Wales.  This means that your use of your Nando's Card and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law.  However, as a consumer, if you are resident in the European Union and we make the Nando's Card available in the member state in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident.  Nothing in these Terms, including this clause 14.1, affects your rights as a consumer to rely on such mandatory provisions of local law.

14.2 If you are a consumer, you may bring any dispute which may arise under these Terms to - at your discretion - either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is an EU Member State, We shall bring any dispute which may arise under these Terms to the competent court of your country of habitual residence if this is in an EU Member State, or otherwise the competent court of England.

Part 6: Eat-In Terms & Conditions

This page tells you the terms and conditions (the "Terms") which apply when you chose to: (i) join a virtual queue; or (ii) order and pay at your table at participating Nando’s restaurants. 

When certain words and phrases are used in these Terms, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Terms where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

In these Terms, when we refer to "we", "us" or "our", we mean the Company; and when we refer to "you" or "your" we mean you, the person accessing or using the services in our restaurants.

1. Information about us

2. Virtual Queue

2.1 At participating Nando’s restaurants we offer a service which allows you to join a virtual queue for a table (the "Virtual Queue Service"). To use the Virtual Queue Service, you will need to either:

     2.1.1 visit one of our participating restaurants and scan the QR code which appears in the window; or

     2.1.2 visit one of our participating restaurants and ask the host to add you to the virtual queue. 

2.2 We use WalkUp to provide the Virtual Queue Service. This means that WalkUp provide us with technical assistance in relation to the Virtual Queue Service. Your use of WalkUp will be governed by Nando’s Terms and Conditions.

2.3 The Virtual Queue Service is provided free of charge. 

2.4 In order to make use of the Virtual Queue Service, you will need Internet access. You are responsible for making all arrangements necessary for you to have access to the Virtual Queue Service. 

2.5 You will be asked to provide certain information (such as your name and phone number) to join the virtual queue. We will use these details to contact you when your table is ready so please ensure that the information you provide when you request a place in the virtual queue is accurate. 

2.6 Please note that your place in the queue is not confirmed until you receive a message informing you that you have been added to the virtual queue.

2.7 You will be sent a message when your table is ready. We ask that you arrive at the restaurant promptly following this message, as we will hold your table for a limited time once the message has been sent.

2.8 You can leave a virtual queue at any time by cancelling your place in the queue.

3. Ordering at your Table

The Order at Table Website

3.1 The Company operates eat-in.nandos.co.uk/store/store-selection (the "Order at Table Website") which allows you to order certain products from our menu ("Products") and have those Products delivered to your table whilst dining at participating Nando's restaurants. 

3.2 The Order at Table Website is made available free of charge but you will have to pay for any Products that you order on the Order at Table Website. We do not guarantee that the Order at Table Website, or any content on it, will always be available or be uninterrupted. Access to the Order at Table Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Order at Table Website without notice. We will not be liable to you if for any reason the Order at Table Website is unavailable at any time or for any period. We may update the Order at Table Website and/or change the content on it at any time. 

3.3 In order to use the Order at Table Website, you will need Internet access. You are responsible for making all arrangements necessary for you to have access to the Order at Table Website. You are also responsible for ensuring that all persons who access the Order at Table Website through your internet connection are aware of these Terms and that they comply with them.

3.4 Please note that:

     3.4.1 you will only be able to use the Order at Table Website whilst dining at a participating Nando's restaurant; and

     3.4.2 you will only be able to order Products during a participating Nando's restaurant's opening hours. You can find details about the opening hours of our restaurants here.

Ordering

3.5 To order Products to be delivered to your table (an "Order"), scan the QR code which is at your table. The QR code will direct you to the Order at Table Website. 

3.6 Please note that alcohol can only be sold to you if you are aged 18 or over. If your Order includes alcohol, you confirm that you are at least 18 years old. You may be asked to verify your age. We reserve the right to refuse to serve you alcohol if you are unable to prove that you are aged 18 or over.

3.7 You will need to follow the procedure set out on the Order at Table Website to submit your Order. Our order process allows you to check and amend any errors before submitting your Order to us. You should check all of the information that you enter and correct any errors before submitting your Order, as once your Order is submitted we will being processing it immediately. 

3.8 Your Order constitutes an offer to us. We will confirm our acceptance of your Order by sending you an email confirming the information you included in your Order (the "Confirmation Email"). These Terms and the Order will become legally binding on you and us when we send you the Confirmation Email and each Order shall incorporate these Terms and shall be a new and separate contract between you and us (the “Contract”). The Contract shall be in the English language. We will not file a copy of the Contract. 

3.9 You will be able to track the status of your Order on the Order at Table Website.  

3.10 If you want to cancel your Order, please speak to a member of staff. 

3.11 The Products you have ordered will be delivered to your table once ready. 

3.12 You have legal rights in relation to Products that are not as described and/or not of satisfactory quality. If you have an issue with any Products that you have ordered, please speak to a member of staff to request a replacement or refund. 

4. Payment

4.1 The prices for the Products are set out on the Order at Table Website and are inclusive of VAT. 

4.2 You will be able to pay by using the payment methods set out in the Order process (the "Payment Methods").  You confirm that the Payment Method which is being used is yours, or that you have the authorisation of the account holder to use it. 

4.3 If your payment is not authorised, your Order will not be sent through to the restaurant's kitchen or fulfilled. 

5. Products

5.1 Information on any allergens that the Products may contain can be found in the Food Allergy & Nutritional Information book (available in all Nando’s restaurants from the manager), but please note that:

     5.1.1 because all Products are cooked to order in the same kitchen we cannot guarantee and make no warranty that the Products will not contain any allergens;

     5.1.2 the kitchen is a busy working environment and there is a risk of cross-contact between ingredients;

     5.1.3 if you have any  special dietary requirements, please let a member of staff at the restaurant know before placing your Order to allow staff to take all reasonable precautions to avoid cross contact; and   

     5.1.4 please consult our menu terms and conditions (set out in Part 3 above) for further information regarding allergens in the Products.

5.2 Our Products are freshly prepared and although we try our best to be consistent, at times the size of the portions can vary.

6. Our liability

6.1 Nothing in these Terms excludes or limits our liability for:

     6.1.1 death or personal injury caused by our negligence;

     6.1.2 fraud or fraudulent misrepresentation; and

     6.1.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

6.2 Subject to clauses ‎6.1 and ‎6.3 our maximum liability to you, in respect of any particular Order, will be limited to the value of that Order as set out in the relevant Confirmation Email.

6.3 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time of the conclusion of the contract for Products.

6.4 We only supply the Products for domestic and private use. You agree not to use the Products for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

6.5 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

7. Changes to these Terms 

7.1 We may make changes to these Terms from time to time (if, for example, there is a change in the law that means we need to change these Terms) but the Terms applicable at the time of your Order will apply to that Order. Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you order the Products.

If you If you live in Northern Ireland you can bring legal proceedings in respect of these Terms in either the Northern Irish or the English courts. 

9.3 As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.  Nothing in these Terms, including clause ‎9.1, affects your rights as a consumer to rely on such mandatory provisions of local law.

We sell The Sauce Collection Nando’s Merchandise via www.nandos.co.uk (the “Website”). These terms of sale (“Terms of Sale”) set out the terms on which you may order such products available on the website (the “Products”)

2. Ordering Products

2.1 You must be at least 18 years old to place an order for Products via the Website (an “Order”).

2.2 Availability:

2.2.1 Nando’s Merch Pop-Up Shop Reading Festival 2022: 11:00AM BST on Friday 26th August till 16:00PM BST Sunday 28th August* 

2.2.2 Online Shop via www.nandos.co.uk/extra-hot-drop: 13:00PM BST on 31st of August 2022, until stocks last.

2.3 Purchases are accessible to valid ticket holders to Reading Festival 2022 at Nando’s Merch Pop-Up Shop Reading 2022 within the timings outlined in 2.1.1, and online purchases for residents within the UK & ROI only.

2.4 Participants will have two opportunities to process an Order:

2.4.1 Nando’s Merch Pop-up Shop Reading Festival 2022: Customer would need to have a valid ticket to Reading Festival 2022 to purchase the Extra Hot Drop Product(s) at the Nando’s Merch Pop-Up Shop onsite, until stocks last.

2.4.2 Online Shop: Customers will need to go to www.nandos.co.uk/extra-hot-drop within the timings outlined within 2.2.2, until stock lasts.

2.5 In order to submit an Order via the Website you must follow the procedure set out on the Website to submit your Order, until stocks last.

2.6 The Order process allows you to check and amend any errors before submitting your Order. Please check your Order carefully before confirming it, as once your Order is submitted, we will be processing it immediately. You are responsible for ensuring that your Order is complete and accurate. The Order process is only available in the English language and we will not file a copy of any contract formed between you and us.

2.7 Your Order constitutes an offer to us. We will confirm our acceptance of your Order by sending you an email confirming the information you included in your Order and providing a delivery estimate (the “Confirmation Email”). These Terms of Sale and the Order will become legally binding on you and use when we send you the Confirmation Email and each Order shall incorporate the Terms of Sale and shall be a new and separate contract between you and us in relation to such order for Products (“Contract”).

2.8 All Customers will be able to order and a maximum of three items per Order for both Purchases made at Nando’s Merch Pop-Up Shop Reading Festival 2022 and via the Website.

2.9 Please note that any purchases made through the Nando’s Merch Pop-Up Shop Reading Festival 2022 or via the Website are intended for domestic, private, and non-commercial use only. You should only make purchases from both the Nando’s Merch Pop-Up Shop Reading 2022 or through the Website if you are acting for purposes that are wholly or mainly outside of your trade, business, craft, or profession (a “Consumer”). By making a purchase through the Nando’s Merch Pop-Up Shop Reading 2022 or through the Website and accepting these Terms of Sale, you represent to us that you are acting as a Consumer and not for purposes relating to your trade, business, craft, or profession.

3 Delivery

3.1 The costs of delivery will be as displayed to you on the Website.

3.2 We will provide you with a delivery estimate during the Order process and will confirm such delivery estimate in the Confirmation Email.

3.3 We aim to deliver Orders within 7 - 10 working days for UK and up to 14 working days for Ireland from when the Order is despatched. We aim to meet these delivery times but due to busy periods deliveries may take a little longer.

3.4 If our supply of the Products is delayed by an event outside our control, then we will contact you as soon possible to let you know and we will take steps to minimise the effect of delay.

3.5 If you do not collect the Products from us as arranged or if, after a failed delivery to you, you do not rearrange delivery or collect them from a delivery depot and the Products are returned to us we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the Contract and clause 7.2 will apply.

3.6 A Product will be your responsibility from the time we deliver the Product to the address you gave us. You own a Product once we have received payment in full.

4 Payment

4.1 The prices for the Product and delivery are set out on the Website and are inclusive of VAT.

4.2 You shall pay for the Products using the payment methods set out in the Order process (the “Payment Methods”). You confirm that the card or bank account which is being used is yours, or that you have the authorisation of the account holder to use it. If you are using a Payment Method which you are not authorised to use, you will be liable to use for any losses that we suffer as a result of your use of Payment Method.

4.3 It is always possible that, despite our best efforts, some of the Products may be incorrectly priced. We will normally check prices before accepting your Order so that, where a Product’s correct price at the time of your Order is less than our stated price at that time, we will charge the lower amount. If the Product’s correct price at the time of your Order is higher than the price states to you, we will contact you for your instructions before we accept your Order. If we accept and process your Order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the Contract and refund you any sums you have paid.

4.4 If your payment is not authorised, your Order will not be fulfilled.

5 Cancellation and refunds

5.1 We are unable to amend or change any Orders once an Order is complete via the Website.  

5.2 You have legal rights in relation to Products that are not as described, faulty or otherwise not fit for purpose. If you believe that any Products that you have ordered via the Website do not confirm with these Terms of Sale, please contact our Customer Services Team.

5.3 If, due to unforeseen circumstances we are unable to fulfil your Order or any of the Products in a particular Order, we will refund the value of the Product(s) that we were unable to fulfil and, if the full Order is cancelled, any delivery charges. You may obtain a refund by contacting us (see clause 12 below for contact details).

5.4 Returns will only be accepted for orders placed via the Website, excluding socks from the Extra Hot Drop range as well as any purchases made at Nando’s Merch Pop-Up Shop Reading Festival 2022. Purchases made at Nando’s Merch Pop-Up Shop Reading 2022 and all Socks from the Website are non-refundable.

5.6 All returns must be received unworn, with the original label intact and valid proof of purchase. Any items received outside of these Terms of sale will not be refunded.

8.1 If you breach any of these Terms of Sale, we may immediately do any or all of the following (without limitation):

8.1.1 issue a warning to you;

8.1.2 temporarily or permanently withdraw your right to use the Website;

8.1.3 issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

8.1.4 take further legal action against you; and/or

8.1.5 disclose such information to law enforcement authorities as we reasonably feel is necessary to do so.

8.2 If we end a Contract in the situations set out in clause 7.1, we will refund any money you have paid in advance for Products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaching the Contract.

8.3 If any act, omission, event or circumstance occurs which is beyond reasonable control which prevents us from complying with these Terms and Conditions we will not be liable for any failure to perform or delay in performing its obligations.

Save your coins when you’re ordering at the table or using Collect. We can’t process codes at the till or on delivery orders right now. If you’re eating in, scan the QR code at the table to follow the web or app journey and order from your table, then you'll be able to use your code at checkout. If your discount code is valid for collect, start your journey on the website or the app and again, enter your discount code at the checkout. NHS discount

NHS staff get 20% off at Nando’s, once a day. All you need to do is activate your discount online with your staff email. We’ll ask you to re-verify every six months.

Your discount will then be automatically applied when you order online or on the app for Eat-in and Collect and are signed in. It’s not available for Delivery.

Prefer to order at the till or don’t have a Nando’s account? You can also show valid ID for NHS.

Just a heads up, the discount amount is capped at £4. If your order’s over £20, you’ll pay full price for the rest of the amount.

WIN A NANDO’S FEAST PROMOTION

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms and Conditions. In the event of a conflict, these Terms and Conditions take precedence. Please retain a copy for your information.

1. THE PROMOTER*

3. WHO CAN ENTER: This Prize promotion (the “Promotion”) is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over at the time of entry excluding employees of the Promoter and their immediate families, the Promoter’s agents, third parties or any other person professionally connected with the Promotion.
 

4. Purchase of a Qualifying Product is necessary and internet access required to enter.

5. PROMOTIONAL PERIOD:

a. The “Main Promotion Period” will begin at 00:01 on 1st February 2024 (the “Opening Date”) and will end at 23:59 on 22nd of March 2024 (the “Main Promotion Period Closing Date”).

d. A person can only have one entry in each of the Main Promotion Period and the Late Entry Draw.
e. Any entrant using multiple address details to enter the promotion will be disqualified and any Prize entitlement will be void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant or household has already submitted an entry and to disqualify the original entry and any subsequent entries or Prize entitlement.

f. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that any entrant or the entrant’s household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple postal addresses; using multiple email addresses, using multiple phone numbers sharing receipts, acting fraudulently or dishonestly in the opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any Prize entitlement will be void.
 

7. MAIN PROMOTION WINNER SELECTION

a. There are 80 prizes available to be won during the Main Promotion Period. Within 2 weeks of the Main Promotion Period Closing Date 80 winners will be drawn by a random computer generator from all eligible entries.

b. A household can win a maximum of one Main Prize throughout the Main Promotion Period.

8. MAIN PROMOTION PRIZES


a. There are 80 prizes. Each prize is a Nando’s restaurant Voucher Code.

b. Email address require to receive prize.
c. The Voucher Code can be redeemed through the app or website for collection orders and at the table for eat-in restaurant orders only. Only allergy orders can be placed at the till. The voucher code cannot be used for delivery orders. The voucher code cannot be used to purchase alcohol, gift packs or grocery products. The Voucher Code is valid for 1 year from issue.

9. LATE ENTRY DRAW DETAILS & WINNER SELECTION

a. Entries received between 00:00 on 23rd March 2024 and 23:59 31st July 2024 will be entered into a random draw to a win a Nando’s restaurant Voucher Code (the “Late Draw Prize”).
b. There are 20 x £100 Nando’s restaurant Voucher Codes, each a Late Draw Prize.

c. Email address require to receive prize.
d. The Voucher Code can be redeemed in restaurants only and are valid for 1 year from issue.

e. The winners of a Late Draw Prize will be the first twenty entrants selected by a random computer generator from all eligible entries within 2 weeks of the Late Entry Draw Closing Date.

f. Only one entry per person.

g. Only one Late Draw Prize per household.

h. Participants awarded a Prize during the Main Promotion Period are not eligible to win in the Late Draw Prize.
 

10. PRIZE FULFILMENT FOR ALL WINNERS


a. Prizes will be emailed to winners within 14 working days of prize claim to the email address used at the point of entry.

b. Prizes are not transferable, and there is no alternative Prize, cash or otherwise, in whole or part. The Prize must be accepted as offered by the named winner(s).

11. PRIZE WINNER NOTIFICATION FOR ALL WINNERS

a. All winners will be notified by a third-party fulfilment agency via email within 14 working days of the respective closing date and asked to provide their proof of purchase. It is a winner’s responsibility to provide their correct, up-to-date details when confirming acceptance of the Prize in order for their Prize claim to be processed. The Promoter cannot be held responsible for a winner failing to supply accurate or complete information which affects Prize acceptance or delivery of their Prize.

b. Winners have 14 days to claim their Prize. If a winner does not respond to notification within the initial 7 days or provide their proof of purchase, they will be contacted again and given a further 7 days to respond. If contact cannot be made or if a winner does not respond within these 14 days or if a winner does not provide their proof of purchase, then the winner shall forfeit their Prize and the Promoter shall be entitled to award that Prize to an alternative winner drawn at the same time as the original.

c. The Promoter does not accept any responsibility in the event a winner is not able to take their Prize.

d. The Promoter reserves the right to verify all winners before a Prize can be dispatched and to withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.

12. LIMITATION OF LIABILITY

Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate entrants for any losses that may be incurred as a result of entering the Promotion and the Promoter does not accept any liability for any loss or damage whatsoever occurring as a result of a winner’s entry or acceptance of a Prize. Nothing in these terms and conditions shall limit the Promoter’s liability for death or injury to a Prize winner caused by the negligence of the Promoter or its agents.

13. DATA PROTECTION

a. Any personal information that entrants share with the Promoter will be kept secure and only used in line with these Terms and Conditions and the Promoter’s privacy policy available at https://www.nandos.co.uk/privacy-policy.
 

b. The Promoter will share winners’ details with a third-party fulfilment agency (Prizeology Limited) for the purposes of administering the prizes only and will share applicable customer details with All About Food Limited for the purpose of Customer Relations only during the Promotional Period. Data will be used and held in accordance with the Promoter's Privacy Policy.
 

c. By entering the Promotion, entrants agree that their information may be used by the Promoter to administer the Promotion in accordance with these terms and conditions.

14. GENERAL
 

a. Promoter’s decision is final and binding in relation to all matters relating to the Promotion. No correspondence will be entered into.
 

b. By entering this Promotion an entrant agrees to be bound by these Terms and Conditions.

c. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Any entrant, or household, who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
 

d. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Promoter.
 

e. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.
 

f. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prize delivery. i. Winners may be asked to take part in reasonable publicity without payment. Such publicity may include, without limitation, using a winner’s name and, if relevant, their image and any statements made by them concerning the Promotion and the Prize won as part of the Promotion.
 

j. If any clause or provision of these Terms and Conditions is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision within
